Whereas industrial milk and industrial cream are agricultural products to which an agreement under the Farm Income Protection Acta does not apply;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture and Agri-Food and the Treasury Board, pursuant to paragraph 18(1)(b) of the Farm Income Protection Acta deeming it necessary for carrying out the purposes and provisions of that Act, hereby makes the annexed Protection for the Income of Milk Producers Regulations (1996).

INTERPRETATION
1. The definitions in this section apply in these Regulations.
“Canadian Dairy Commission” means the corporation established by section 3 of the Canadian Dairy Commission Act. (Commission canadienne du lait)
“domestic requirements” means the quantity of industrial milk and industrial cream, as measured by the Canadian Dairy Commission’s Stock Reconciliation Method, delivered for sale for use in
(a) dairy products intended for Canadian domestic consumption; or
(b) cheese intended for the European Union. (besoins intérieurs)
“producer” means a person who resides in Canada and produces industrial milk or industrial cream in Canada. (producteur)
APPLICATION
2. These Regulations apply to industrial milk and industrial cream that
(a) are delivered, within domestic requirements, during the period beginning on April 1, 1996 and ending on July 31, 2001; or
(b) were delivered, within domestic requirements, before the period referred to in paragraph (a) and in respect of which no payment was made by the Canadian Dairy Commission under paragraph 9(1)(c) of the Canadian Dairy Commission Act.
PAYMENT TO THE CANADIAN DAIRY COMMISSION
3. The Minister shall pay to the Canadian Dairy Commission an amount, for the purpose of protecting the income of producers earned from the sale of industrial milk and industrial cream delivered within domestic requirements, by supplementing that income by the following amount:
(a) for industrial milk and industrial cream delivered during the period beginning on April 1, 1996 and ending on July 31, 1996, $1.28138 per kg of butterfat;
(b) for industrial milk and industrial cream delivered during the period beginning on August 1, 1996 and ending on January 31, 1998, $1.05525 per kg of butterfat;
(c) for industrial milk and industrial cream delivered during the period beginning on February 1, 1998 and ending on January 31, 1999, $0.84420 per kg of butterfat;
(d) for industrial milk and industrial cream delivered during the period beginning on February 1, 1999 and ending on January 31, 2000, $0.63315 per kg of butterfat;
(e) for industrial milk and industrial cream delivered during the period beginning on February 1, 2000 and ending on January 31, 2001, $0.42210 per kg of butterfat; and
(f) for industrial milk and industrial cream delivered during the period beginning on February 1, 2001 and ending on January 31, 2002, $0.21105 per kg of butterfat.

COMING INTO FORCE
4. These Regulations come into force on June 13, 1996.
